Terms of Service

By accessing or using Kodo ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. These Terms apply to all visitors, users, and others who access or use the Service.

Kodo is a developer productivity platform that tracks coding activity through IDE extensions (VS Code, JetBrains IDEs, and others). The Service collects heartbeat data — file activity metadata, programming languages, project names, and editor information — to provide insights, session summaries, and coding analytics. Kodo does not read or transmit the contents of your code.

You must create an account to use the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us immediately of any unauthorised use of your account.

Some features of the Service are available only through a paid subscription. Subscription fees are billed in advance on a recurring basis. You authorise us to charge your payment method for all fees incurred.

Subscriptions automatically renew unless cancelled before the renewal date. You may cancel at any time through your account settings. Refunds are not provided for partial billing periods unless required by applicable law.

You agree not to:

• Use the Service for any unlawful purpose or in violation of these Terms
• Attempt to gain unauthorised access to the Service or its related systems
• Interfere with or disrupt the integrity or performance of the Service
• Reverse engineer, decompile, or otherwise attempt to extract the source code of the Service
• Use automated means to access the Service in a way that exceeds reasonable usage
• Resell or sub-license access to the Service without our written permission

The Service and its original content, features, and functionality are and will remain the exclusive property of Kodo and its licensors. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.

You retain ownership of any data you generate through your use of the Service. By using the Service, you grant Kodo a limited, non-exclusive licence to process that data solely to provide and improve the Service.

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review it carefully to understand our practices.

The Kodo IDE extensions (VS Code, JetBrains, and others) are provided under these Terms. The extensions collect activity metadata — file paths, programming languages, timestamps, and editor information — and transmit it to the Kodo API. No source code content is ever read or transmitted. You may opt in to additional features such as symbol capture via your extension settings.

We may terminate or suspend your account immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will immediately cease.

You may delete your account at any time through your account settings. Upon deletion, your personal data will be removed in accordance with our Privacy Policy.

The Service is provided on an "AS IS" and "AS AVAILABLE" basis without any warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components.

To the maximum extent permitted by applicable law, Kodo shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, goodwill, or other intangible losses, arising out of or in connection with your use of the Service.

Our total liability to you for any claim arising out of or relating to these Terms or the Service shall not exceed the greater of (a) the amount you paid us in the 12 months preceding the claim, or (b) $100 USD.

These Terms shall be governed by and construed in accordance with applicable law, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the competent courts.

We reserve the right to modify these Terms at any time. We will provide notice of significant changes by updating the "Last updated" date at the top of this page. Your continued use of the Service after any changes constitutes acceptance of the new Terms.
